How We Collect Personal Information: We collect personal information through three primary sources:
  • Provided by You – We receive information when you shop with us, register for an account or rewards program, sign up or request to be placed on our mailing, SMS text or email marketing lists, contact us, or participate in an event, survey, or promotion.
    • Social Media. Our online Services may include functionality that allows certain kinds of interactions between our Services and your account on a third-party website or application. For example, we may provide links on our online Services to facilitate sending a communication from our Services, or we may use third parties to facilitate emails, posts or Facebook, Instagram, TikTok or Pinterest postings. 2. PURPOSE FOR COLLECTING AND PROCESSING

How We Collect Personal Information:It is necessary for us to collect certain information to allow you to complete transactions, provide you with many features and services, and explain our offerings to you. Not all the purposes described here are relevant to every customer.

  • Providing You with Products and Services – Including fulfilling your orders, processing your returns and exchanges, processing your payments, providing you with information regarding experiences and events that you have attended, processing account registrations or rewards program applications, managing your account(s), and facilitating logging into your account(s).
  • Marketing and Advertising – Developing, managing, and conducting advertising and marketing campaigns about TPS, our brands, and other third parties we work with, including through direct mail offerings. We may use personal information to serve targeted ads and analyze and measure the performance and reach of our advertising and marketing efforts (on our online Services and elsewhere) based on your online activities and how you interact with our advertising and marketing. We may also use personal information to create and identify audiences that are most likely to respond to ads based on information we collected or infer about your interests and preferences.
  • Communicating with You – Responding to your inquiries, providing customer service and technical support, sending you transactional and related communications about your purchases, loyalty and reward programs, product and policy changes, and notifying you of product recalls. We may also send you communications about promotions, events, surveys, and other offers, products, and services we think may be of interest to you via various channels, including direct mail, where we may use third-party data to acquire your address.
  • Maintaining and Improving Our Products, Business Operations and Services – Operating, troubleshooting, improving, and developing new online Services and features to better serve you, learning how you and other users interact with and respond to our online Services and advertisements, and learning about your in-store experience. We may also use for other internal business purposes, including to conduct internal analytics.
  • Personalizing Online Content and Experiences – Personalizing your online content, providing you recommendations and reminders, and enhancing the quality and your overall experience with our online services (like retaining your user preferences and presenting content in the most effective manner for the browser or device you use to access our online services). We may try to establish cross-device connections and link the different browsers and devices you use to access or use our online services to help us recognize you as a customer or visitor and provide you with a seamless and consistent personalized experience when interacting with us using different browsers or devices.
  • Security, Legal and Compliance – Protecting our assets and preventing fraudulent transactions, validating credentials and authenticating customers when logging into your online profile or transacting in-store, protecting the security and integrity of our stores, services and our data, assisting law enforcement and responding to legal/regulatory inquiries, maintaining and complying with our legal and regulatory obligations (such as privacy requests, preferences and choices).
  • Other Purposes With Consent - For purposes disclosed at the time you provide your information or as otherwise set forth in this Privacy Policy.

We may also create aggregated, de-identified, or other anonymous data from personal information we collect. We make personal information into anonymous data by removing information that makes the data personally identifiable to you. We reserve the right to use this anonymous data and share it with third parties for our lawful business purposes. To the extent we or our service providers process anonymous data, we will maintain and use the information in de-identified form and will not attempt to re-identify the information unless permitted by applicable law.

For example, service providers may process personal information on our behalf to process payment card transactions, distribute communications, operate online and other communication methods such as online chat, manage offers and promotions, and provide services for order fulfillment and logistics, data analytics, computer and cloud-based networks, and fraud prevention.
  • Parent companies, subsidiaries, successor entities, and corporate affiliates within the TPS brands that are subject to this Policy.
  • Companies with whom you authorize us to share information, such as when you request we accept payment from a third-party payor or financing company or when you sign up for a loyalty program administered by a third party.
    • The Hallmark Crown Rewards Loyalty is administered by Hallmark and provided to TPS as a service. When you sign up for the Hallmark Gold Crown Rewards Loyalty Program, your information will be shared with Hallmark and you will receive marketing communications directly from Hallmark. Please refer to Hallmark's privacy policy here for more details or to edit your information/opt out of their program.
  • We may share feedback you provide to us with vendors or the public (such as through review sites or social media). We are excited when customers want to share feedback with us about the products and services they have purchased and what we offer. If you ask a question about a product, respond to a question about a product, submit an online review or tag us in a social media post (including if you use a photo), please be aware that this feedback may be publicly shared and used by us on our websites or our social media sites without compensation or attribution.
  • Parties Involved in Corporate Transactions: We may share your information in connection with any merger, financing, acquisition, or dissolution transaction or proceeding involving the sale, transfer, divestiture, or disclosure of all or a portion of our company or assets. If another company acquires our company or assets, that company may possess the personal information collected by us and will assume the consents and responsibilities regarding your personal information.
  • Others (when required by law or as necessary to protect our rights): We may share your information to comply with an applicable law or upon the government’s request, in response to a court order or subpoena, or when we have a good faith belief that we are required to do so by law, or where otherwise permitted by law. We may also share your information to comply with state auditing reports.

  • Data Brokers: We may share your information with data brokers for data enrichment and marketing. These parties may combine your personal information with their own records for their own purposes.

A Note on Selling: TPS may share data with third parties to provide you with the best experience. We do not sell personal information in exchange for money.

4. COOKIES, MARKETING TAGS AND OTHER TECHNOLOGY

We gather information about how visitors navigate and use our website or stores to deliver more personalized experiences and improve site performance, using tools such as “cookies”, “marketing tags” and session replay software. We use various methods and technologies to store or collect Usage Information ("Tracking Technologies"). Tracking Technologies may set, change, alter or modify settings or configurations on your device. A few of the Tracking Technologies used on our online Services, include, without limitation, the following (and subsequent technology and methods later developed):


(a) Cookies, Pixels and Web Beacons

A cookie is a file placed on a device to uniquely identify your browser and to store information on your device. Our online Services may use HTTP cookies, HTML5 cookies, and other types of cookie technology to store information on local storage. Regular cookies may generally be disabled or removed by tools that are available as part of most commercial browsers, and in some (but not all) instances can be blocked by selecting certain settings. Each browser you use will need to be set separately and different browsers offer different functionality and options.

Please note that these tools may not be effective with regard to HTML5 cookies. Please understand that if you disable or remove any type of cookie, some parts of our online Services may not function properly, and that when you revisit our online Services your ability to limit cookies is subject to your browser settings and limitations. 

A pixel or web beacon is a small tag (which may be invisible to you) that may be placed on our online Services. Here are some examples of what these technologies allow us to do:

  • Remember what items are in your shopping bag
  • Enable faster checkout if you have created an account at one of our websites
  • Personalize your web experience
  • Apply the preferences you’ve chosen

An embedded script is programming code that is designed to collect information about your interactions with our online Services, such as the links you click on within our online Services. The code is temporarily downloaded onto your device from our web server or one of our third-party service providers, is active only while you are connected to our online Services, and is deactivated or deleted thereafter.

(c) Browser Fingerprinting

Browser fingerprinting functions by collecting and analyzing information from your device, such as, without limitation, your operating system, plug-ins, system fonts and other similar data, for purposes of identification.

(d) Recognition Technologies

Recognition technologies, including application of statistical probability to data sets, attempt to recognize or make assumptions about users and devices (e.g., that a user of multiple devices is the same user).

We use the above Tracking Technologies (or ones we incorporate in the future):

  • to allow you to use and access our online Services;
  • for the prevention of fraudulent activity and improved security functionality;
  • to allow you to make use of shopping cart functionality;
  • to assess the performance of our online Services, as part of our analytic practices and to improve the content, products or services offered through our online Services;

  • to keep track of your specified preferences and to track your online activities over time and across third-party sites; and

(e) Session Replay

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our websites through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising.   • to allow you to use and access our online Services;
  • for the prevention of fraudulent activity and improved security functionality;
  • to allow you to make use of shopping cart functionality;
  • to assess the performance of our online Services, as part of our analytic practices and to improve the content, products or services offered through our online Services;
  • to identify you when you visit or sign-in to our online Services;
  • to keep track of your specified preferences and to track your online activities over time and across third-party sites; and
  • to deliver content, including ads, relevant to your interests on our online Services and third-party sites based on how you interact with our advertisements and/or content.

(f) Chat and Customer Service Communications

We employ live customer service representatives to respond to customer inquiries. To aid our customer service representatives, we engage contact center software providers to provide certain services to us, such as click-to-call telephone services. These providers will have access to the information needed to perform their functions (such as caller ID, phone numbers, date/time, duration, and other call metadata as well as voicemail and recordings) but cannot use that information for any direct marketing purpose. Conversations are recorded, and recorded conversations are not sold, shared, or used for purposes of targeted advertising.

Our website also provides a chat option for website visitors, which uses automated chatbot technology. Chat conversations are recorded, and used internally by us to improve our website. Recorded chat conversations are not sold, shared, or used for purposes of targeted advertising.

  • to allow you to make use of shopping cart functionality;
  • to assess the performance of our online Services, as part of our analytic practices and to improve the content, products or services offered through our online Services;

  • to keep track of your specified preferences and to track your online activities over time and across third-party sites; and
  • to deliver content, including ads, relevant to your interests on our online Services and third-party sites based on how you interact with our advertisements and/or content.

(g) Location-Based Information

Our online Services collect and use information on your location to deliver you relevant content and advertising based on your IP address as part of the location-based services we offer. We use your location information to display our nearest store location to you. You have the ability to turn location-based services on and off by adjusting the settings of your Internet browser or mobile device or by following the standard uninstall process and if applicable, removing all TPS applications from your mobile device.

(h) Third Party Analytics Providers

We use analytics services to better understand how customers use our websites in order to improve those technologies and optimize your experience and interactions. We may share data with these analytics providers, or they may collect it for our usage.  If you wish to opt out of allowing Google to collect analytics information, please visit Google Analytics Opt-out Browser Add-on.

(i) In-Store Video Footage

We use cameras in various locations throughout our stores. These cameras capture video and images of you as you shop. This technology helps us understand how traffic flows throughout our store, identify what’s on our shelves and racks, and detect and respond to damage, theft, fraud, security, or safety issues. This footage may be shared with third-party vendors as needed for security purposes or to pursue claims, including law enforcement. Footage is kept on file per our video retention policies for a period of 90 days, unless the footage is related to an incident, in which case it is kept on file indefinitely.

5. YOUR CHOICES TO CORRECT, EDIT OR OPT-OUT

(a) To submit a Request to Delete, Request to Correct, Request to Opt Out of Targeted Advertising, or Request to Access Data: 

  • The laws of several states provide residents with certain consumer privacy rights. We currently allow all our U.S. customers the ability to make the requests identified below, regardless of state of residency, but reserve the right to prioritize requests received from residents in states where these options are required by law.
  • To initiate these consumer privacy requests, please submit a Privacy Request Form or click “Privacy Request” in the footer of our website. You may also call our Customer Service team (844) 480-7100 or email us at [email protected]. Please note that our response to your request will be sent via email. 
  • Right to Delete: You have the right to request that we delete your personal information. Once we receive and verify your request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies Please note, we will continue to maintain limited information needed to comply with product recalls, fraud prevention, and other legal and business requirements, including a record of your privacy request.
  • Request to Correct: You have the right to request that we correct, rectify and/or update any of your personal information that is incorrect, incomplete or out of date.
  • Request to Opt-out of Targeted Advertising: TPS does not sell your personal information to third parties. Like many companies, however, we do share personal information with third parties to provide you with personalized advertising from us, or we make available personal information to third parties (through cookies - or similar technologies - provided by third parties on our online Services). These companies often use personal information to improve their own products and optimize their own ad targeting systems. You have the right to direct us not to share your personal information for purposes of cross-context behavioral marketing, and the right to opt out of the processing of your personal information for purposes of targeted advertising. Please note that this will have the effect of opting you out of mailed communications and digital marketing communications via email and text email marketing (it will not opt you out of transactional email or texts).
  • Request to Know: You have the right to know whether we are processing your personal information and request that we disclose a report of your personal information, including the categories and specific pieces of personal information we have about you, the categories of sources from which the personal information has been obtained, the business or commercial purpose for collecting, selling, or sharing personal information, and the categories of third parties to whom we disclose personal information (as well as which categories of information were disclosed). Residents of California and Maryland have the right to obtain a list of the categories of third parties to which we have disclosed your personal information.


Before we may process a request to know, delete, or correct your personal information, in order to protect your privacy, we will ask you to confirm a few pieces of information that we have on our records about you, for example:

If you are making a request to correct involving these items of information, we will work with you to find another means of verifying your identity that will not involve the subject matter of the request to correct. We may also require information from you to demonstrate that our data is incorrect. This information shall only be used and/or maintained by us for the purpose of correcting your personal information and to comply with any record-keeping obligations we may have under the law.

If you make a request online to delete your personal information, we may need to confirm your request before we delete your information.
